Legalization of residence in Poland

We provide legal assistance regarding legalization of residence in Poland, including applying for:

  • temporary residence permit (including an unitary permit for temporary residence and work)
  • permanent residence permit
  • long-term resident's EU residence permit
  • Schengen visas or national visas (including their renewals)
  • extension of stay in visa-free travel
  • Polish card
  • Polish citizenship

Our services include, among others: assistance in preparing or supplementing the application, explanation of the administrative procedures, submitting appeals against rejection decisions or decisions on withdrawal of the residence permit as well as submitting complaints to the administrative court.

We work with both individual and corporate clients - among others we offer assistance for employers who want to legally hire foreigners from non-EU countries.

In certain cases, we are able to help to legalize the status of a foreigner in Poland despite the illegality of his or her stay.


Inactivity and excessive length of proceedings of public administrative entities

Public administrative entities are obliged to issue a decision within a specified time limit (in principle, within two months from the date of initiation of proceedings).

In case decision is not issued on time, the public administrative entity is obliged to notify the applicant – stating the reasons for the delay, indicating a new deadline for handling the case and informing about the right to submit a reminder to a competent authority.

If the court finds out about inactivity or excessive length of the administrative proceedings, the applicant has right to demand a payment in the amount of up to PLN 20,000.00 from the public administrative entity.

We carefully analyze each situation of potential inactivity or excessive length of proceedings of a public administrative entity in cases regarding foreigners and prepare relevant procedural letters in this regard, including a reminder and a complaint to the administrative court. We represent clients at every stage of the proceedings, ensuring that their rights and interests are fully protected.


Sole proprietorship in Poland

Both citizens of the Member States of the European Union or the European Economic Area, as well as people from other countries, have the possibility to set up and conduct business activity in the Republic of Poland.

We help foreigners to prepare and provide all necessary documents, to obtain NIP (Tax Identification Number) and REGON (National Business Registry Number), to register of business activity, to make changes in the Central Register and Information on Economic Activity (CEIDG), as well as to suspend and terminate business activity.

We provide comprehensive legal assistance in matters related to conducting a business activity by foreigners in Poland, including preparing and analyzing texts of contracts, as well as pursuing claims in connection with non-performance or improper performance of contracts.


Company law

We provide comprehensive assistance for foreigners in the scope of ongoing legal services for corporate entities, as well as the creation, merger and liquidation of commercial companies remaining under the Polish law regime.

We advise our clients (including people from outside the European Economic Area) in choosing the most advantageous form of running a business activity, merging or transforming a commercial company, as well as changing the ownership structure of the company.

We ensure the preparation of relevant documentation (including, but not limited to, the articles of association and agreements on transfer of shares) and comprehensive legal support in the course of the company's day-to-day operations.


Actions for payments

We offer legal assistance for foreigners in the recovery of debts - from both natural persons and entrepreneurs - at the pre-court, court and enforcement stage.

Before taking legal action before the court, we prepare a call for payment and - when the situation allows - we try to lead to an amicable settlement of the dispute.

In case it is necessary to pursue a claim in court, we prepare a lawsuit, evidence motions, other pleadings and appeals, as well as provide professional representation before the court by an attorney-at-law.

After the court decision has been implemented, we apply for the enforcement clause and represent our client before the court enforcement officer at the stage of enforcement proceedings.


Compensation cases

We provide legal assistance for foreigners in obtaining damages and compensation for material and intangible damages both from private entities (natural persons, private persons) and insurance companies at the pre-litigation, court and enforcement stage.

    We have extensive experience in obtaining damages and compensation in connection with, among others:
  • transport accidents,
  • accidents at work and on the way to work,
  • medical errors,
  • property destruction,
  • canceled or delayed flights,
  • failure to perform or improper performance of contracts.

Labor law

    We offer help in labor law cases regarding foreigners for both employers and employees, in matters of:
  • preparation, analysis and correction of employment contracts and annexes to employment contracts,
  • counseling in the scope of employer's obligations related to employing foreigners,
  • disputes regarding termination of an employment contract,
  • disputes regarding remuneration and fines,
  • collective redundancies,
  • claims related to the employees’ liability for entrusted property,
  • claims related to the violation of the non-competition clause,
  • establishing the existence of an employment relationship,
  • claims related to mobbing and violation of the principle of equal treatment.

Social security law

    Our assistance for foreigners regarding social security law includes:
  • advice on determining and obtaining the right to social security benefits,
  • representation of clients in disputes with ZUS (Polish Social Insurance Institution),
  • preparing appropriate documentation to obtain benefits,
  • making appeals from negative decisions.

Criminal law and penal-fiscal law

We provide our foreign clients with legal representation and defense in criminal and penal-fiscal cases at all stages of the criminal process.

Our assistance includes defending suspects (defendants) at every stage of the criminal proceedings, including the preparation of ordinary and extraordinary remedies, as well as a comprehensive analysis of the case in terms of the possibility of using probation measures, including conditional discontinuance of criminal proceedings or conditional suspension of punishment.

We also provide legal representation of victims at the stage of pre-trial investigation as well as auxiliary prosecutors and private prosecutors at the stage of court proceedings. We prepare offence notifications, evidence motions, appeals, subsidiary indictment and a private indictment.


Real estate

We advise foreigners on the acquisition, lease and tenancy of real estate within the territory of the Republic of Poland. In certain cases, the purchase of real estate by foreigners from outside the European Economic Area requires obtaining a permit from the Minister of Interior and Administration.
